酒に酔つて公衆に迷惑をかける行為の防止等に関する法律
Act on the Prevention, etc. of Acts that a Drunken Man Causes Trouble to the Public
(昭和三十六年六月一日法律第百三号)
(Act No. 103 of June 1, 1961)
(目的)
(Purpose)
第一条 この法律は、酒に酔つている者(アルコールの影響により正常な行為ができないおそれのある状態にある者をいう。以下「酩酊者」という。)の行為を規制し、又は救護を要する酩酊者を保護する等の措置を講ずることによつて、過度の飲酒が個人的及び社会的に及ぼす害悪を防止し、もつて公共の福祉に寄与することを目的とする。
Article 1 The purpose of this Act is to prevent the excessive alcohol consumption from causing personal and social damages by taking measures to regulate the act of a person who is drunk (a person who is not likely to perform normal acts under the influence of alcohol. Hereinafter referred to as "inebriated person") and to rescue an inebriated person who is required for aid thereby contribute to the public welfare.

(Moderate Drinking)
第二条 すべて国民は、飲酒を強要する等の悪習を排除し、飲酒についての節度を保つように努めなければならない。
Article 2 All citizens shall endeavor to stop the evil practice of compelling people to drink alcohol or other evil practices and to use moderation in their drinking.

(Rescue)
第三条 警察官は、酩酊者が、道路、公園、駅、興行場、飲食店その他の公共の場所又は汽車、電車、乗合自動車、船舶、航空機その他の公共の乗物(以下「公共の場所又は乗物」という。)において、粗野又は乱暴な言動をしている場合において、当該酩酊者の言動、その酔いの程度及び周囲の状況等に照らして、本人のため、応急の救護を要すると信ずるに足りる相当の理由があると認められるときは、とりあえず救護施設、警察署等の保護するのに適当な場所に、これを保護しなければならない。
Article 3 Police officers must rescue an inebriated person temporarily under the appropriate shelter like an aid station or a police station when the person uses or carries out rude or violent words and deeds in streets, parks, railway stations, entertainment facilities, eating and drinking places, and other public places or on steam trains and electric trains, buses, ships and vessels, aircrafts, and other public transportations (hereinafter referred to as "public places or transportations") and then the officers find reasonable grounds to believe that the person is in need of short term help in the light of the person's words and deeds, drunkness, and the existing conditions.
2 前項の措置をとつた場合においては、警察官は、できるだけすみやかに、当該酩酊者の親族、知人その他の関係者(以下「親族等」という。)にこれを通知し、その者の引取方について必要な手配をしなければならない。
(2) When police officers take the measures under the preceding paragraph, the officers must notify the measures to relatives, acquaintances or other relevant parties of the inebriated person (hereinafter referred to as "the relatives, etc.") as soon as possible and make necessary arrangements to release the inebriated person.
3 第一項の規定による保護は、責任ある親族等の引取りがない場合においては、二十四時間をこえない範囲内でその酔いをさますために必要な限度でなければならない。
(3) When relatives responsible for releasing the inebriated person do not appear, the rescue under Paragraph 1 shall not exceed 24 hours within the limit necessary for sobering up the person.
4 警察官は、第一項の規定により保護をした者の氏名、住所、保護の理由、保護及び引渡しの時日並びに引渡先を毎週当該保護をした警察官の属する警察署所在地を管轄する簡易裁判所に通知しなければならない。
(4) Police officers must weekly notify a summary court having jurisdiction over the location of the police station where the police officers who rescue the person are assigned of the name, address, reason of rescue, rescue and release dates, and the responsible person for the released under Paragraph 1.

(Penal Provisions)
第四条 酩酊者が、公共の場所又は乗物において、公衆に迷惑をかけるような著しく粗野又は乱暴な言動をしたときは、拘留又は科料に処する。
Article 4 When an inebriated person uses or carries out extremely rude or violent words and deeds that may cause trouble to the public in public places or transportations, the person shall be punished by misdemeanor imprisonment without work or a petty fine.
2 前項の罪を犯した者に対しては、情状により、その刑を免除し、又は拘留及び科料を併科することができる。
(2) When the person commits the crime under the preceding paragraph, the court may exculpate the person from misdemeanor imprisonments without work or petty fines, or may impose misdemeanor imprisonments without work and petty fines cumulatively on the person, in light of the existing conditions.
3 第一項の罪を教唆し、又は幇助した者は、正犯に準ずる。
(3) A person who induces or aids the crime set forth in Paragraph 1 is equivalent to a principal.
第五条 警察官は、前条第一項の罪を現に犯している者を発見したときは、その者の言動を制止しなければならない。
Article 5 When police officers find the person who is committing the crime set forth in Paragraph 1 of the preceding article, the officers must stop the person from using or carrying out the words and deeds.
2 前項の規定による警察官の制止を受けた者が、その制止に従わないで前条第一項の罪を犯し、公衆に著しい迷惑をかけたときは、一万円以下の罰金に処する。
(2) When a person who is given a police officer's cease order under the provisions of the preceding paragraph commits the offenses in violation of the order set forth in Paragraph 1 of the preceding article and causes extreme trouble to the public, the person shall be punished by fine of not more than 10,000 yen.

(Entry)
第六条 警察官は、酩酊者がその者の住居内で同居の親族等に暴行をしようとする等当該親族等の生命、身体又は財産に危害を加えようとしている場合において、諸般の状況から判断して必要があると認めるときは、警察官職務執行法(昭和二十三年法律第百三十六号)第六条第一項の規定に基づき、当該住居内に立ち入ることができる。
Article 6 Police officers, when the officers find it necessary judging from the various circumstances, may enter the residence of an inebriated person pursuant to Article 6 Paragraph 1 of the Police Official Duties Execution Act (Act No. 136 of 1948) where an inebriated person is just about to inflict injury on the life, body or property of the relatives, such as intending to assault upon the relatives living together at the residence of the person.

(Notification)
第七条 警察官は、第三条第一項又は警察官職務執行法第三条第一項の規定により酩酊者を保護した場合において、当該酩酊者がアルコールの慢性中毒者(精神障害者を除く。)又はその疑のある者であると認めたときは、すみやかに、もよりの保健所長に通報しなければならない。
Article 7 Where police officers rescue an inebriated person pursuant to Article 3 Paragraph 1 of this Act or Article 3 Paragraph 1 of the Police Official Duties Execution Act and when police officers find that the inebriated person is a chronic alcoholic (except the mentally ill) or a person who is suspected as a chronic alcoholic, police officers must promptly notify the chief of the nearest public health center about the person.

(Medical Examinations)
第八条 前条の通報を受けた保健所長は、必要があると認めるときは、当該通報に係る者に対し、医師の診察を受けるようにすすめなければならない。この場合において、保健所長は、当該通報に係る者の治療又は保健指導に適当な他の医療施設を紹介することができる。
Article 8 When the chief of the public health center that has received the notification in the preceding article finds it necessary, the chief must advise the person involved in the notification to see a doctor. In this case, the chief may refer the person to other medical institutions that offer treatment or health guidance for the person.
第九条 前条前段の規定により医師の診察を受けるようにすすめられた者がそのすすめに従つて受ける診察及び診察の結果必要と診断された治療については、当該診療を受ける者が困窮のため最低限度の生活を維持することのできないものであるときは、生活保護法(昭和二十五年法律第百四十四号)第十五条に規定する医療扶助を受けることができる。
Article 9 When a person who will receive medical treatment according to the advice under the first sentence of the preceding article is unable to maintain a minimum standard of living due to poverty, the person can receive medical assistance set forth in Article 15 of the Public Assistance Act (Act No. 144 of 1950) with regard to a medical examination by a doctor and a necessary treatment considered from the result of the examination.
(適用上の注意)
(Due Care in Application of this Act)
第十条 この法律の適用にあたつては、国民の権利を不当に侵害しないように留意しなければならない。
Article 10 In the application of this Act, care shall be taken not to improperly infringe upon the rights of citizens.
附 則
Supplementary Provisions
 この法律は、公布の日から起算して三十日を経過した日から施行する。
This Act shall come into force on the day on which 30 days have elapsed from the date of promulgation.
