(趣旨)
(Purpose)
第1条 名古屋大学(以下「本学」という。)に在学する学生の懲戒及び教育的措置については,名古屋大学通則(平成16年度通則第1号)及び名古屋大学大学院通則(平成16年度通則第2号)に定めるもののほか,この規程の定めるところによる。
Article 1 Disciplinary actions and educational measures against the students at Nagoya University (hereinafter referred to as "the university") shall be governed by this regulation, in addition to Nagoya University General Rules (General Rule No.1 of 2004) and Nagoya University Graduate School General Rules (General Rule No.2 of 2004).
(懲戒等の対象となる行為)
(Conducts Subject to Disciplinary Actions etc.)
第2条 懲戒又は教育的措置(以下「懲戒等」という。)の対象となる行為は,次のとおりとする。
Article 2 Conducts subject to disciplinary actions or educational measures (hereinafter referred to as "disciplinary actions etc.") shall be as follows:
一 本学の教育研究活動を妨害する行為
(i) conducts that obstruct education and research activities in the university;
二 ハラスメントに該当する行為
(ii) conducts that fall under harassment;
三 不正アクセス等情報倫理に反する行為
(iii) conducts that violate information ethics such as unauthorized access;
四 守秘義務違反等専門職倫理に反する行為
(iv) conducts that violate professional ethics such as breach in confidentiality; or
五 その他大学の名誉・信用を著しく失墜させる行為
(v) other conducts that seriously discredit honor or credibility of the university.
(懲戒の種類・効果)
(Types and Effects of Disciplinary Actions)
第3条 懲戒の種類及び効果は,次のとおりとする。
Article 3 The types and the effects of disciplinary actions shall be as follows:
一 退学 学生としての身分を喪失させること。
(i) Expulsion - to deprive one's status as a student;
二 停学 6月未満の期間を定めて,又は期間を定めずに,登校を禁じること。
(ii) Suspension - to prohibit one from attending school either with specified period of time of under six months or without specified period.
三 訓告 学生に対して文書により注意を与え,将来を戒めること。
(iii) Admonishment - to issue a warning to a student in a written form and admonish the student for the future.
2 前項第2号の場合において,停学期間は,在学年限に含め,修業年限には含めないものとする。
(2) In the case of Item 2 of the preceding paragraph, the suspension period shall be included in the period of attendance and shall not be included in the required periods of study.
3 学生は,停学又は訓告の処分が行われた場合は,反省文を総長に提出しなければならない。
(3) In the case where the discipline of suspension or admonishment has been enforced, the student shall submit a statement of regret to the president.
(教育的措置の種類・効果)
(Types and Effects of Educational Measures)
第4条 教育的措置は,学生の本分についての反省を促す措置であり,第9条に規定する懲戒委員会の議を経て,学生の所属する部局の教授会又は研究科委員会(以下「教授会等」という。)において行う。
Article 4 Educational measures are the measures to prompt reflection over obligation of a student and, following deliberation of disciplinary committee provided for in Article 9, shall be enforced by the faculty meeting of the department or the committee of graduate school where the student is enrolled (hereinafter referred to as "faculty meeting etc.").
2 教育的措置の種類及び効果は,次のとおりである。
(2) The types and the effects of educational measures shall be as follows:
一 厳重注意 口頭により注意を与え,反省を強く求めること。
(i) Serious Warning - to issue oral admonishment and demand sincere repentance; or
二 注意 口頭により注意を促すこと。
(ii) Warning - to issue oral admonishment.
3 部局の長は,教育的措置を行う場合,当該学生に反省文の提出を求めることができる。
(3) In case where educational measures are to be enforced, the head of the department may require the student to submit a statement of regret.
(定期試験等における不正行為)
(Wrongdoings in Semester Examinations etc.)
第5条 定期試験等における不正行為については,懲戒等に加えて,当該学生が当該学期において修得した全授業科目の単位を原則として不認定とする。
Article 5 With regard to wrongdoings in semester examinations etc, in addition to disciplinary actions etc, acquired credits of all courses by the student within the semester shall not be, in principle, certified.
(事案の報告)
(Report of the Case)
第6条 部局の長は,当該部局に所属する学生について,懲戒等の対象となる事案が生じた場合は,速やかに事実関係を把握し,総長に報告するものとする。
Article 6 When a case that may lead to disciplinary actions, etc. occurs concerning a student of a department, the head of the department shall promptly grasp the situation and report to the president.
2 前項の規定にかかわらず,第2条第2号に係る事案については,別に定めるところにより,名古屋大学ハラスメント防止対策委員会(以下「防止対策委員会」という。)が事実関係を把握し,総長に報告するものとする。
(2) Notwithstanding the provision of the preceding paragraph, with regard to the case pertaining to Article 2 Item 2, the Nagoya University Harassment Prevention Committee (hereinafter referred to as "Prevention Committee") shall grasp the situation and report to the president pursuant to other provisions.
(調査委員会)
(Investigation Committee)
第7条 部局の長は,前条の報告の後,速やかに,教授会等の下に,調査委員会を設置して,事実の確認及び当該学生に対する事情聴取を行うものとする。
Article 7 After the report set forth in the preceding Article, the head of the department shall promptly set up an investigation committee under the faculty meeting, etc., confirm the facts and interview the student.
2 前項の規定にかかわらず,第2条第2号に係る事案については,防止対策委員会が行う処分の勧告の後に調査委員会を設置し,防止対策委員会から受けた事実調査の報告をもって事実の確認に代えるものとする。
(2) Notwithstanding the provision of the preceding paragraph, with regard to a case pertaining to Article 2 Item 2, the head of the department shall set up an investigation committee after the recommendation of disciplinary actions by the Prevention Committee. The report of the fact-finding received from the Prevention Committee shall serve as the confirmation of the facts.
3 調査委員会は,前項の事情聴取に際しては,当該学生に対し,口頭又は文書による弁明の機会を与えなければならない。ただし,当該学生が,弁明の機会を与えられたにもかかわらず,正当な理由なく欠席し,又は弁明書を提出しなかった場合は,この権利を放棄したものとみなす。
(3) In the course of the interview set forth in the preceding paragraph, the investigation committee shall give the student an opportunity to explain themselves orally or in writing; provided however, that the student shall be deemed to have waived this right when, despite being given an opportunity of explanation, the student does not appear or submit a statement of explanation without justifiable grounds.
4 調査委員会は,事情聴取に際し,当該学生から補佐人の同席又は陳述について求めがあったときは,これに応じなければならない。ただし,事情聴取の妨げになると調査委員会が認めた場合には,補佐人の数を制限することができる。
(4) When the investigation committee receives from the student a request of the presence of an assistant or statements by an assistant in the course of the interview, the investigation committee shall respond to the request; provided however, that the number of the assistants may be limited when the investigation committee recognizes that the response impedes the interview.
5 調査委員会は,事実の確認及び事情聴取の結果に基づき,調査報告書を作成し,教授会等に報告しなければならない。
(5) Based on the outcome of the confirmation of the facts and the interview, the investigation committee shall prepare an investigation report and report to the faculty meeting, etc.
(教授会等の審議)
(Deliberation of the Faculty Meeting, etc.)
第8条 教授会等は,前条第5項の報告に基づいて審議を行い,処分等申請書(別記様式第1号)に処分又は措置(以下「処分等」という。)に関する意見書を付して,総長に提出する。
Article 8 The faculty meeting, etc. shall deliberate the case based on the report set forth in paragraph 5 of the preceding article and submit to the president an application form for dispositions, etc.(the Appended Form No.1) with a written opinion on dispositions or educational measures(hereinafter referred to as "dispositions, etc".)
(懲戒委員会)
(Disciplinary Committee)
第9条 総長は,前条の申請を受けたときは,懲戒委員会を設置して,当該部局の教授会等から提出された処分等申請書及び処分等に関する意見書に基づく審議を求めるものとする。
Article 9 When the president receives the application set forth in the preceding paragraph, the president shall set up a disciplinary committee and instruct the committee to deliberate the case based on the application form for dispositions, etc. and the written opinion submitted by the faculty meeting of the department.
2 懲戒委員会は,次に掲げる委員をもって組織する。
(2) The disciplinary committee shall be composed of the following members:
一 理事又は副総長のうち総長が指名した者2名
(i) two persons designated by the president among the trustees or the vice-presidents;
二 当該部局の長
(ii) the head of the department; and
三 教育研究評議会評議員のうち総長が指名した者2名
(iii) two persons designated by the president among the councilors of the Education and Research Council.
3 懲戒委員会に委員長を置き,前項第1号の委員のうち総長が指名した者をもって充てる。
(3) The disciplinary committee shall have a chairperson who shall be designated by the president among the committee members set forth in Item 1 of the preceding paragraph.
4 委員長は,懲戒委員会を招集し,その議長となる。
(4) The chairperson shall convene the disciplinary committee and preside at meetings.
5 懲戒委員会は,当該事案について,懲戒等の可否,処分等の案等に係る報告書を総長に提出しなければならない。
(5) The disciplinary committee shall, about the case, submit the report pertaining to the decision whether or not to take disciplinary actions, etc. and a proposal of dispositions, etc. to the president.
(懲戒委員会の再調査)
(Reinvestigation by the Disciplinary Committee)
第10条 懲戒委員会は,審議に当たり,事実関係の再調査が必要と認めたときは,当該学生又は補佐人から事情聴取を行うことができる。
Article 10 When the disciplinary committee finds it necessary to reinvestigate the facts in the course of the deliberation, the committee may interview the student or the assistant.
2 前項の事情聴取に当たっては,第7条第3項及び第4項の規定を準用する。
(2) The provisions of Article 7 Paragraph 3 and Paragraph 4 shall apply mutatis mutandis to the interview set forth in the preceding paragraph.
(懲戒委員会の定足数)
(Quorum of the Disciplinary Committee)
第11条 懲戒委員会は,構成員の3分の2以上の出席がなければ,議事を開き,議決することができない。
Article 11 The disciplinary committee shall not open a meeting or pass any resolutions unless more than two-thirds of the members of the committee are present.
2 懲戒委員会の議事は,出席者の過半数をもって決し,可否同数のときは,議長の決するところによる。
(2) All decisions of the disciplinary committee shall be made by the majority of the attendees. In the case of a tie, the chairperson shall decide the issue.
3 前2項の規定にかかわらず,処分等の案を議決するためには,構成員の全員が出席し,4分の3以上の賛成を得なければならない。
(3) Notwithstanding the provisions of the preceding two paragraphs, attendance of all the members and the affirmative votes of three-fourths or more shall be required to make a decision on a proposal of a disposition, etc.
4 前項の議決の方法は,無記名投票による。
(4) The decision set forth in the preceding paragraph shall be made by way of secret voting.
(処分等の決定)
(Decision of Dispositions, etc.)
第12条 総長は,懲戒委員会の審議の結果,懲戒処分の必要があると認めるときは,教育研究評議会の議を経て,懲戒処分を決定するものとする。
Article 12 When, as a result of deliberations in the disciplinary committee, the president finds it necessary to take a disciplinary action, the president shall take a disciplinary action following deliberation in the Education and Research Council.
2 総長は,前項の決定に基づき,当該処分の結果を当該部局の長に通知するものとする。
(2) Based on a decision set forth in the preceding paragraph, the president shall notify the head of the department of the result of the disciplinary action.
3 総長は,懲戒委員会の審議の結果,教育的措置の必要があると認めるときは,当該部局の長に通知するものとする。
(3) When, as a result of deliberations in the disciplinary committee, the president finds it necessary to take educational measures, the president shall send the notice to the head of the department.
4 部局の長は,前項の通知に基づき,教授会等の議を経て,教育的措置を決定し,当該措置の結果を総長に報告するものとする。
(4) Based on a notice set forth in the preceding paragraph, the head of the department shall decide educational measures following deliberation in the faculty meeting, etc. and report the result of the measures to the president.
(処分等の告知)
(Notice of Dispositions, etc.)
第13条 懲戒処分の告知は,部局の長が懲戒処分告知書(別記様式第2号)を学生に交付して行うものとする。
Article 13 Notice of a disciplinary action shall be provided by the head of the department delivering Written Notice of Disciplinary Action(Appended Form No. 2)to a student.
2 部局の長は,前項により懲戒処分の告知を行った場合は,教授会等に報告するとともに,懲戒処分の決定を,当該学生の氏名を伏して,一般学生に公示するものとする。
(2) When the head of the department notifies a disciplinary action in accordance with the preceding paragraph, the head of the department shall submit the notice to the faculty meeting, etc. and publicly notify the decision of a disciplinary action to the student body without disclosing the student's name.
3 教育的措置の告知は,部局の長が学生に対し,口頭により行うものとする。
(3) The head of the department shall notify educational measures to the student orally.
(懲戒処分の効力)
(Effect of a Disciplinary Action)
第14条 懲戒処分の効力は,懲戒処分告知書を学生に交付したときに生じるものとする。
Article 14 When Written Notice of Disciplinary Action is delivered to the student, the disciplinary action shall become effective.
2 前項の懲戒処分告知書の交付は,これを受けるべき学生の所在を知ることができない場合においては,公示送達又は他の適切な方法により行うものとする。
2 Where the head of the department is unable to identify the whereabouts of the student who is to receive Written Notice of Disciplinary Action under the preceding paragraph, the notice shall be delivered through service by publication or through other appropriate methods.
(期間計算)
(Calculation of the Period of Time)
第15条 第3条第1項第2号に規定する停学の期間計算は,暦日計算による。この場合において,期間の初日は,これを算入しない。
Article 15 Calculation of the period of suspension prescribed in Article 3 Paragraph 1 Item 2 shall be governed by calculation of calendar days. In this case, the first day of the period shall not be included in the calculation.
(異議申立て)
(Objections)
第16条 懲戒処分(定期試験等において不正行為を行い教育的措置を受けた場合及び第5条により修得単位を不認定とされた場合を含む。以下この条(第8項を除く。)において同じ。)の告知を受けた学生は,当該処分の異議がある場合は,総長に対し,異議申立書(別記様式第3号)により異議を申し立てることができる。
Article 16 When a student receives a Notice of Disciplinary Action and has an objection against the disposition (including cases receiving an educational measures for misconduct in semester examinations and cases of un certification of acquired credits pursuant to Article 5; hereinafter the same shall apply in this Article (excluding Paragraph 8).),the student may file an objection against the president by submitting Objection (Appended Form No. 3.)
2 前項の異議申立ては,懲戒処分の告知を受けた後,速やかに行わなければならない。
(2) The student shall promptly file an objection set forth in the preceding paragraph after receiving a Notice of disciplinary Action.
3 総長は,第1項の異議申立てがあったときは,懲戒委員会に付議するものとする。
(3) When the objection set forth in Paragraph 1 is filed, the president shall submit the objection to Disciplinary Committee for deliberation.
4 懲戒委員会は,当該異議申立てについて審査を行い,総長に報告書を提出しなければならない。
(4) Disciplinary Committee shall examine the objection and submit a report to the president.
5 前項の審査に当たっては,第7条第3項及び第4項の規定を準用する。
(5) The provisions of Article 7 Paragraph 3 and Paragraph 4 shall apply mutatis mutandis to the examination set forth in the preceding paragraph.
6 総長は,第4項の報告の結果,懲戒処分の減免の必要があると認めた場合は,教育研究評議会の議を経て,当該処分の減免を決定するとともに,当該部局の長に通知するものとする。
(6) When the president finds it necessary to alleviate or exempt the disciplinary action, based on the outcome of the report set forth in Paragraph 4,the president shall decide alleviation or exemption of punishment following deliberation in the Education and Research Council and notify the decision to the head of the department.
7 懲戒処分の減免の告知は,部局の長が処分等減免通知書(別記様式第4号)を学生に交付して行うものとする。
(7) Notice of alleviation or exemption of disciplinary action shall be provided by the head of the department delivering Written Notice of Alleviation or Exemption of Disciplinary Action(Appended Form No. 4)to a student.
8 部局の長は,前項により懲戒処分の減免の告知を行った場合は,教授会等に報告するとともに,懲戒処分の減免の決定を,当該学生の氏名を伏して,一般学生に公示するものとする。
(8) When the head of the department notifies alleviation or exemption of disciplinary action set forth in the preceding paragraph, the head of the department shall submit the notice to the faculty meeting, etc. and publicly notify the decision of alleviation or exemption of disciplinary action to the student body without disclosing the student's name.
9 総長は,第4項の報告の結果,異議申立てに理由がないと認めた場合は,教育研究評議会の議を経て,当該異議申立ての棄却を決定するとともに,当該部局の長に通知するものとする。
(9) When the president finds the objection without any justifiable grounds, based on the outcome of the report set forth in Paragraph 4, the president shall dismiss the objection following deliberation in the Education and Research Council and notify the decision to the head of the department.
10 異議申立ての棄却の告知は,部局の長が異議申立棄却通知書(別記様式第5号)を学生に交付して行うものとする。
(10) Notice of dismissal of objection shall be provided by the head of the department delivering Written Notice of Dismissal of Objection(Appended Form No. 5)to a student.
(停学処分の解除)
(Discontinuation of Suspension)
第17条 部局の長は,停学処分を受けた学生について,その反省の程度,学習意欲等を総合的に判断して,当該処分の解除が妥当であると認めた場合は,教授会等の議を経て,総長に対し,停学処分解除申請書(別記様式第6号)により,当該処分の解除を申請することができる。
Article 17 When the head of the department finds it appropriate to discontinue the disposition of suspension taking every factor into consideration such as student's sincere repentance and enthusiasm for learning etc., the head of the department may apply for discontinuation of the disposition of suspension to the president by the Written Application of Discontinuation of Suspension (Appended Form No. 6) following the faculty meeting, etc.
2 総長は,前項の申請があった場合は,懲戒委員会に付議するものとする。
(2) When the application set forth in the preceding paragraph is filed, the president shall submit the application to Disciplinary Committee for deliberation.
3 総長は,前項の懲戒委員会の議に基づき,教育研究評議会の議を経て,当該処分の解除を決定するとともに,当該部局の長に通知するものとする。
(3) Based on a deliberation of Disciplinary Committee set forth in the preceding paragraph, the president shall decide discontinuation of the disposition following a deliberation in the Education and Research Council and notify the decision to the head of the department.
4 処分の解除の通知は,部局の長が,停学処分解除通知書(別記様式第7号)を学生に交付して行うものとする。
(4) A notice of discontinuation of disciplinary action shall be provided by the head of the department delivering Written Notice of Discontinuation of Suspension(Appended Form No.7)to a student.
5 第1項の規定にかかわらず,期間を定めない停学は,当該学生に懲戒処分告知書を交付した時から,原則として6月を経過した後でなければ,解除することができない。
(5) Notwithstanding the provision set forth in Paragraph 1, suspension without specifying a period shall not be, in principle, discontinued after six months from the issue of Written Notice of Disciplinary Action.
(運用上の留意点)
(Due Considerations in Implementation)
第18条 この規程の運用に当たっては,当該学生の基本的人権を尊重するよう留意するとともに,教育上必要な配慮をするものとする。
Article 18 In implementing this Regulation, fundamental human rights of the student shall be respected and due consideration from educational point of view shall be given to the student.
(雑則)
(Miscellaneous Provisions)
第19条 この規程に定めるもののほか,学生の懲戒等に関し必要な事項は,教育研究評議会の議を経て,総長が別に定める。
Article 19 In addition to what is provided for in this Regulation, necessary matters concerning to disciplinary action of students shall be separately determined by the President, following deliberation in the Education and Research Council.
附 則
(Supplementary Provisions)
この規程は,平成18年4月1日から施行する。
This Regulation shall come into force as from April 1, 2006.

Supplementary Provisions (Regulation No. 92 of March 30, 2009)
この規程は,平成21年4月1日から施行する。
This Regulation shall come into force as from April 1, 2009.
